Welcome to YomiKamo. These Terms of Use ("Terms") govern your access to and use of the YomiKamo website and services (the "Service"). By accessing or using the Service, you agree to these Terms.

1. Definitions

"Service" means the YomiKamo website, application, and related services. "Account" means a registered user account. "User Content" means content you submit (e.g., messages, feedback). "We" means Forethought Studio (France).

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.

3. Accounts and Security

You are responsible for all activity on your Account and for maintaining the confidentiality of your credentials. Notify us promptly if you suspect unauthorized access. We may suspend access to protect the Service or users.

4. Acceptable Use

You agree not to:

• Use the Service for unlawful, harmful, or fraudulent purposes.
• Scrape, crawl, or use automated systems without our written permission.
• Reverse engineer, decompile, or attempt to extract source code, data, or models.
• Bypass access controls, rate limits, authentication, or security measures.
• Upload malware or interfere with the Service’s availability or performance.
• Impersonate another person or misrepresent your affiliation.
• Share or sell your Account credentials, or allow others to access your Account.

5. Service Rules and Enforcement

We may remove content, restrict access, or terminate Accounts that violate these Terms or harm the Service or other users. We may investigate and cooperate with law enforcement where required.

6. License and Intellectual Property

The Service, including its content, design, software, and trademarks, is owned by YomiKamo or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial study, subject to these Terms.

7. User Content and Feedback

You retain ownership of your User Content. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, host, display, and process it to operate, maintain, and improve the Service. You represent that you have the rights to submit your User Content.

8. Copyright Complaints

If you believe content on the Service infringes your copyright, contact us through the Contact page with details of the work, the allegedly infringing material, and your contact information. We will respond in accordance with applicable law.

9. Third-Party Services

The Service may integrate third-party services (e.g., authentication, analytics, or content sources). Your use of those services is subject to their terms and policies, which are not controlled by YomiKamo.

10. Availability, Changes, and Beta Features

We may modify, suspend, or discontinue parts of the Service at any time. Some features may be offered as beta or preview features and are provided "as is" and may change without notice.

11. Communications

By creating an Account, you consent to receive service-related communications (such as security notices or updates). You can opt out of promotional messages at any time.

12. Payments

YomiKamo is currently free during beta and no subscription is required right now. If we introduce paid plans, applicable pricing (including taxes), billing cadence, and renewal terms will be shown before purchase.

Paid subscriptions will auto-renew by default at the selected billing interval unless canceled before the next renewal date. You can cancel renewal at any time from account settings, and cancellation takes effect at the end of the current paid period unless required otherwise by law.

Refunds are generally not provided for partially used periods, except where required by applicable law. If a billing error occurs, contact support and we will investigate and correct verified overcharges.

13. Data and Privacy

Our Privacy Policy describes how we collect, use, and share information. You agree to our Privacy Policy by using the Service.

14. Account Deletion and Data Retention

You may request account deletion using the Account deletion page. After confirmation, deletion is scheduled after a short grace period. Some information may be retained as required by law or for legitimate business purposes, and backups may persist for a limited time. See the Privacy Policy for details.

15. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted access, accuracy, or that the Service will be error-free. Your study outcomes depend on many factors outside our control.

16. Limitation of Liability

To the fullest extent permitted by law, YomiKamo is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the Service.

17. Indemnification

You agree to indemnify and hold YomiKamo harmless from claims arising from your misuse of the Service or violation of these Terms.

18. Termination

We may suspend or terminate access if you violate these Terms, if we are required by law, or to protect the Service or users.

19. Dispute Resolution and Venue

Before filing a formal claim, please contact us so we can try to resolve the issue. Any disputes will be resolved in the competent courts of Paris, France, unless mandatory consumer law requires a different venue.

20. Governing Law

These Terms are governed by the laws of France, unless mandatory consumer law requires otherwise.

21. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

22. Assignment

You may not assign these Terms without our consent. We may assign these Terms as part of a merger, acquisition, or asset transfer.

23. Entire Agreement

These Terms, together with the Privacy Policy and any posted policies, form the entire agreement between you and YomiKamo regarding the Service.

24. Changes to Terms

We may update these Terms from time to time. Continued use after changes take effect means you accept the updated Terms.
